1. INFORMATION FOR USERS
Who is the Controller responsible for processing your personal data?
Pinedeal S.L. is the Data Controller responsible for processing the personal data of the USER and hereby informs you that such data shall be processed in accordance with Regulation (EU) 2016/679 of 27 April (General Data Protection Regulation, hereinafter “GDPR”) and Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (hereinafter “LOPDGDD”).
What is the purpose of processing your personal data?
To maintain a commercial relationship with the user. The processing operations envisaged for this purpose are:
- Sending commercial advertising communications by email, fax, SMS, MMS, social networks or any other electronic or physical means, whether existing or future, that enables the transmission of commercial communications. Such communications shall be carried out by the CONTROLLER and shall relate to its own products and services, or those of its collaborators or suppliers with whom a promotional agreement has been entered into. In such cases, third parties shall not be granted access to personal data under any circumstances.
- Conducting market research and statistical analysis.
- Processing orders, requests, enquiries or any type of request submitted by the USER through any of the contact channels made available on the website.
- Sending the online newsletter containing news, offers and promotions relating to the CONTROLLER’s activities.
What is the legal basis for processing your personal data?
The processing of personal data is legitimised under Article 6 of the GDPR on the following grounds:
- With the USER’s consent: for the sending of commercial communications and newsletters.
- On the basis of the CONTROLLER’s legitimate interests: for the conducting of market research and statistical analysis, and for the processing of orders, requests and enquiries submitted at the USER’s own initiative.
For how long will your personal data be retained?
Personal data shall be retained only for as long as is necessary to fulfil the purpose for which it was collected, or for such period as may be required by applicable legal obligations. Upon the expiry of the applicable retention period, data shall be securely deleted using appropriate technical measures to ensure anonymisation or complete destruction.
To whom may your personal data be disclosed?
No disclosure of personal data to third parties is envisaged, unless such disclosure is strictly necessary for the development and execution of the purposes of the processing. Where applicable, data may be disclosed solely to service providers engaged in communications-related activities, with whom the CONTROLLER has entered into the appropriate confidentiality and data processing agreements required under current data protection regulations.
What are your rights?
The USER is entitled to exercise the following rights:
- The right to withdraw consent at any time, without affecting the lawfulness of processing carried out prior to such withdrawal.
- The right of access, rectification, data portability and erasure of personal data, as well as the right to restriction of or objection to its processing.
- The right to lodge a complaint with the competent supervisory authority (Agencia Española de Protección de Datos, www.aepd.es) if the USER considers that the processing of their personal data does not comply with applicable data protection regulations.

2. MANDATORY OR VOLUNTARY NATURE OF THE INFORMATION PROVIDED BY THE USER
By ticking the relevant boxes and entering data in the fields marked with an asterisk (*) on the contact form or download forms, USERS expressly and freely accept that the provision of such data is necessary for the CONTROLLER to process their request. The completion of any remaining fields is voluntary. The USER warrants that the personal data provided to the CONTROLLER is accurate and undertakes to notify the CONTROLLER of any subsequent changes thereto.
The CONTROLLER hereby informs USERS that all data requested through the website is mandatory, as it is required in order to provide an optimal level of service. Failure to provide all required data may result in the CONTROLLER being unable to guarantee that the information and services offered fully correspond to the USER’s needs.
3. SECURITY MEASURES
In accordance with applicable personal data protection regulations, the CONTROLLER complies with all provisions of the GDPR and LOPDGDD governing the processing of personal data under its responsibility. The CONTROLLER expressly adheres to the principles enshrined in Article 5 of the GDPR, under which personal data must be processed lawfully, fairly and transparently in relation to the data subject, and must be adequate, relevant and limited to what is necessary in relation to the purposes for which it is processed.
The CONTROLLER guarantees that it has implemented appropriate technical and organisational measures to apply the security standards established by the GDPR and LOPDGDD with a view to protecting the rights and freedoms of USERS, and has provided USERS with the information necessary for the exercise of those rights.
